Your privacy matters to us. This policy explains what personal information Muse Hair Studio collects, why we collect it, how we look after it and the rights you have under the Protection of Personal Information Act 4 of 2013 (“POPIA”).

1. Who we are

2. Information we collect

We only collect the information we need for the purposes described in this policy. Depending on how you interact with us, this may include:

  • your name, email address and telephone number;
  • appointment details, such as the service, stylist, date and time you book;
  • service preferences and notes about your hair, such as previous colour or treatments;
  • messages you send us;
  • account details, if you choose to create an account when booking;
  • payment-related information, where payments are handled by a third-party payment provider;
  • your marketing preferences; and
  • IP address and technical information collected by our hosting and security systems.

3. How we collect it

We collect personal information directly from you when you:

  • complete a form on our website;
  • book through our online booking system;
  • contact us by email, telephone or WhatsApp; or
  • visit the salon and speak to us in person.

Some technical information is collected automatically through cookies and similar technologies (see our Cookie Policy) and by our hosting and security providers. Where you pay online, the payment is processed by a secure third-party payment provider.

4. Why we process it

We use personal information to:

  • respond to your enquiries;
  • schedule, confirm and manage appointments, including reminders;
  • provide our services safely and to a good standard;
  • process payments;
  • communicate with you about your appointments;
  • improve our website and services;
  • keep our website and systems secure;
  • comply with our legal obligations; and
  • send marketing messages, where the law allows (see section 7).

5. Lawful processing

POPIA allows us to process personal information only where there is a lawful justification. Not everything we do relies on consent. Depending on the purpose, we rely on one or more of the following:

  • Contract: the processing is necessary to take steps at your request before booking, or to provide a service you have booked.
  • Legal obligation: the processing is necessary to comply with the law, for example tax and accounting requirements.
  • Legitimate interests: the processing is necessary for our legitimate interests or those of a third party, such as keeping our website secure or improving our services, and those interests are not outweighed by your rights.
  • Consent: you have agreed to the processing, for example to receive marketing emails. You may withdraw your consent at any time. Withdrawing consent does not affect processing that took place before you withdrew it.

6. Health information you share with us

To keep you safe during colour, chemical and treatment services, you may choose to tell us about allergies, sensitivities or reactions to products. This may be health information, which POPIA treats as special personal information. We only use it to plan and provide your service safely, we limit who can see it, and we process it with your consent or where the law otherwise permits.

7. Marketing

We will only send you electronic direct marketing, such as marketing emails, SMS or WhatsApp messages, where POPIA allows it. In general this means:

  • you have given us your consent; or
  • you are an existing client, we obtained your contact details when providing a service to you, and we are marketing our own similar services. In this case you must have been given a reasonable opportunity to object when your details were collected, and you have not objected.

Every marketing message will identify us and give you a simple way to opt out, free of charge. You can unsubscribe at any time by using the unsubscribe link in any marketing email or by contacting us at info@prowebdesign.co.za.

8. Sharing

We do not sell your personal information. We share it only where appropriate and lawful, with service providers that help us run the salon and website, such as:

  • website hosting and security providers;
  • our online booking system;
  • our payment provider;
  • email and messaging providers; and
  • professional advisers such as accountants and attorneys.

We require service providers that process personal information on our behalf to keep it confidential and secure. We may also disclose information where the law requires it.

9. Cross-border processing

Some of our service providers may store or process information outside South Africa. Where this happens, we will only transfer personal information in accordance with POPIA’s requirements for cross-border transfers, for example where the recipient is subject to laws or binding agreements that provide an adequate level of protection, or where you have consented.

For example, some of the email and cloud storage services we use may store information on servers outside South Africa.

10. Retention

We keep personal information only for as long as reasonably necessary for the purpose it was collected for, to meet contractual requirements, to comply with legal obligations or for legitimate business needs, such as keeping a record of past services. When we no longer need it, we delete, destroy or de-identify it.

11. Security

We take reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access and unlawful processing. These include limiting access to people who need it and using reputable service providers. No website or system can be completely secure, however, so we cannot guarantee absolute security. If we become aware of a security compromise affecting your personal information, we will notify you and the Information Regulator as POPIA requires.

12. Your rights

Under POPIA, you have the right, subject to the conditions and exceptions in the law, to:

  • be told when your personal information is being collected;
  • ask whether we hold personal information about you and request access to it;
  • ask us to correct or update inaccurate, incomplete or out-of-date information;
  • ask us to delete or destroy information we are no longer authorised to keep;
  • object to the processing of your information on reasonable grounds, where the law allows;
  • object to direct marketing at any time;
  • withdraw your consent where we rely on it; and
  • lodge a complaint with the Information Regulator.

To exercise any of these rights, contact us at info@prowebdesign.co.za. We may need to confirm your identity before responding. Requests for access may be dealt with under the Promotion of Access to Information Act 2 of 2000.

If you have a concern about how we handle your personal information, please contact us first at info@prowebdesign.co.za or 076 260 2730 so we can try to resolve it.

You also have the right to complain to the Information Regulator (South Africa), which monitors and enforces compliance with POPIA. Website: inforegulator.org.za

14. Children

Our website is not intended for children, and we do not knowingly collect children’s personal information through it. If a child’s appointment is booked, it should be booked by a parent or guardian, who provides the information needed on the child’s behalf.
